Terms and Conditions

These terms govern your use of daynadaydesigns.com and any order you place with us. Dayna Day Designs is a textile and home decor brand owned and operated by Printivize LLC, based in Rockland, Massachusetts. In these terms, “we”, “us” and “our” mean Printivize LLC trading as Dayna Day Designs.
By using this site or placing an order, you agree to what follows. If you don’t agree, please don’t use the site.
Placing an order
An order placed through the site is an offer to buy, not a completed contract. We accept your order when we confirm it and begin production. We may decline or cancel an order — and refund you in full — if an item is unavailable, if a price or description was published in error, if we can’t verify your payment or delivery details, or if the work requested would infringe someone else’s rights.
Product photographs, swatches and mockups are representations. Handmade and printed goods carry natural variation, and finished items may differ slightly from what’s shown on screen.
Prices and payment
Prices are in US dollars and exclude shipping and applicable sales tax, which are calculated at checkout. We may change prices at any time, but a change never affects an order we’ve already accepted. Payment is taken in full at the time of order unless we’ve agreed otherwise in writing.
If a price is listed incorrectly through an obvious error, we’ll contact you before producing the order and give you the choice of paying the correct price or cancelling for a full refund.
Made-to-order work, proofs and personalization
Nearly everything we sell is produced to order. For personalized work — embroidery wording, monograms, custom photo pillows, wedding stationery — you’ll approve a proof before production, and approving that proof means accepting the artwork as shown, including spelling, names and dates.
Cancellations, remakes and refunds are governed by our Returns & Refunds Policy, which forms part of these terms.
Shipping and delivery
Production and shipping estimates are estimates, not guarantees. Risk of loss passes to you when the carrier takes possession of your order. If a package is lost or damaged in transit, tell us within 7 days of the expected or actual delivery date and we’ll work with the carrier and make it right under our returns policy.
You’re responsible for providing an accurate, deliverable shipping address. We aren’t liable for orders delivered to an address you entered incorrectly.
Our designs and intellectual property
Every pattern we sell begins as an original watercolor. Our designs, artwork, patterns, product photography, text and the site itself are owned by us and protected by copyright and other intellectual property laws.
Buying a product gives you the product — it does not transfer any rights in the design. Unless we agree otherwise in writing, you may not:
- Reproduce, scan, digitize, trace or redraw our designs
- Print our patterns yourself or have them printed by anyone else
- Sell, license or distribute our artwork as artwork, digital files or print files
- Use our designs or photography in your own branding, packaging or marketing
Fabric and wallpaper you buy from us may be made into finished goods for your own use, and small-scale makers may sell handmade items made from our fabric. What isn’t permitted is reproducing the pattern itself, or mass production without a license. If you want to use our designs commercially at scale — in a product line, a hospitality or contract project, or a licensed collection — email us. We’re glad to discuss it.
Artwork and content you supply
When you send us a photograph, logo, monogram, wording or any other content to be produced, you confirm that you own it or have permission to use it, and that producing it won’t infringe anyone’s copyright, trademark, publicity or privacy rights.
You grant us the license needed to reproduce that content in order to make your item. We may decline any job we believe infringes someone’s rights or is unlawful, hateful or obscene, and you agree to cover us for any claim arising from content you supplied.
We may photograph completed work and show it as an example of what we make. If your piece is personal and you’d rather we didn’t, just tell us and we won’t.
Commissioned and custom design work
Where we create an original design to your commission, the terms of ownership, licensing and usage will be set out in the quote or agreement for that project. Unless that agreement says otherwise, we retain ownership of the underlying artwork and grant you a license to use it for the agreed purpose.
Trade, wholesale and designer accounts
Trade, wholesale and designer orders may be covered by separate terms agreed at the time of order. Where those terms conflict with these, the agreed terms take precedence.
Your account
If you create an account, you’re responsible for keeping your password confidential and for activity that happens under it. Tell us promptly if you think someone else has access. We may suspend or close an account that’s being used fraudulently or in breach of these terms.
Acceptable use of this site
Please don’t attempt to gain unauthorized access to the site or its systems, interfere with its operation, scrape it in bulk, or use it to transmit malicious code or unsolicited commercial messages.
Disclaimers
We work hard to keep the site accurate and available, but we provide it “as is” and can’t promise it will always be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.
Nothing here excludes any warranty or right that can’t legally be excluded, and nothing here limits your rights under applicable consumer protection law.
Limitation of liability
To the fullest extent permitted by law, our total liability arising out of or relating to an order is limited to the amount you paid for that order. We aren’t liable for indirect or consequential losses — lost profits, lost opportunity, or the costs of an event or project that depended on the order.
Practically speaking: if we get something wrong, we’ll remake it or refund it. We can’t underwrite the cost of a wedding or an installation that went ahead on the strength of it.
Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Massachusetts, and we each consent to that jurisdiction.
Changes to these terms
We may update these terms from time to time. The version in effect when you place an order is the version that governs that order. Changes are shown by the date at the top of this page.
